Privacy Statement

We recognize the importance of protecting the privacy of all information provided by our customers and visitors of our web site. We created the following policy guidelines with a respect for your right to privacy and also because we are legally required to do so.
  

The responsible party for the processing of personal data on this web site is X-Ways Software Technology AG. There is no specially appointed data protection officer. The basis of data processing is Art. 6 Abs. 1 lit. f in the German DSGVO, which allows processing of data for contractual fulfillment and pre-contract activities. You have the right to receive information about the origin, recipient and purpose of your personal data as processed by us, for free. You also have the rights to object against processing of your data and to demand correction, locking and deletion of your data. Deletion is not possible if preserving the recorded data is required by law (e.g. tax laws or regulations). After deletion we may not be able to recognize you as a license owner any more. The duration of data storage depends on its purpose and legal requirements.

If you have any questions about this privacy statement, the practices of this web site, or your dealings with us, please contact us. You have the right to complaint with the responsible data protection supervision authority.

When you request pages from our web site, the servers automatically collect some information about you, including your IP address. This address is used by computers on the network to send the requested pages to you. Our web site is hosted by the company IONOS SE, which therefore acts as a data processor for us and also receives the information of visitors of our web site. If you choose to download our software from an alternative server in the USA when given the option to do so, some of information about you including your IP address will be automatically recorded by the hosting company in the US in the process.

We do not use tracking cookies, secret pixels or any other form of medium- or long-term user recognition/tracking mechanism. We also do not use any form of third-party marketing or advertiser cookies on our pages, nor do we employ third-party tracking, advertising or social media integration elements at all. No data of our web site visitors is forwarded to data behemoths likes Google Analytics, Facebook etc. Our entire website can be used in private browsing mode without restricting the user experience. Where session cookies are necessary for technical reasons (e.g. on our web forms), we only employ single-use cookies, whose purpose is limited to a specific page and which are forgotten and re-issued on each new page visit.

Information that you provide when posting on the user forum may be available for all to see. Discretion should be used in entering personally identifiable information within the forum, as it may be collected by third parties. The forum is no place where to put confidential information.

If you ever send us an e-mail message or give us your e-mail address (or postal address) in some other way, your address will be kept strictly confidential, you will never be added to a spam list, and we will not contact you other than to answer your question, etc. E-mail messages may be archived by us. We will not reveal any personal information that you disclose to us to any third party without your permission, and we use reasonable precautions to keep it secure. 

We occasionally send out e-mail newsletters about our software products to everyone who signed up for receiving them. You can indicate at any time that you do not wish to receive these newsletters any more (follow a link that can be found at the end of every mailing).

When purchasing services or licenses of any of our products from us, the information that you provide at that occasion may be kept on record, including names and addresses, payment method, etc. We use reasonable precautions to keep this information strictly confidential. IP adresses, e-mail addresses and customer names and addresses may be stored for several years as that can be required for verification purposes (for example retrieval of license files, VAT applicability) and to fulfill our contractual obligations and in order to offer existing customers individual prices for license renewals etc.

After having purchased licenses for our software, unless you disagree, for your convenience your e-mail address may be used on our web site to query your license status, which will then be e-mailed to that address. License codes to unlock our software may be generated individually for you, based on the personal information you provide with your order.

We do not share data recorded by us with third parties. We do not forward data to servers outside of the European Union. Possible exceptions are customers that have received the “OutsideIn” component of Oracle (Oracle may request a list of such customers).

We are not responsible for the content or the privacy policies of web sites to which we may provide links.

We urge children who visit our web site only to provide any information after they have discussed it with their parents.
